LICENSE AGREEMENT - VisualAge for Java, Entry Edition, Version 2.0
PLEASE READ THIS VISUALAGE FOR JAVA, ENTRY EDITION, VERSION 2.0 LICENSE AGREEMENT (CALLED THE "LICENSE") CAREFULLY. YOUR DOWNLOADING, INSTALLING OR USE OF THE VISUALAGE FOR JAVA, ENTRY EDITION, VERSION 2.0 SOFTWARE AND ASSOCIATED DOCUMENTATION (CALLED THE "SOFTWARE") INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT DOWNLOAD, INSTALL OR USE THE SOFTWARE.
1. Limitations
The Software is limited to the creation of 500 new Java classes.
2. Ownership and License
The Software, including any copies that you make, is owned by International Business Machines Corporation ("IBM") or an IBM supplier and is copyrighted and licensed, not sold. The Software consists of machine-readable instructions, audio/visual content (such as software documentation) and related licensed materials and includes all copies thereof.
IBM grants you free of charge a non-exclusive, non-transferable license to install and use the Software on a reasonable number of machines in your organization. You may also copy the Software for backup purposes. All copies that you make must bear the same legends and notices that appear on the original copy of the Software.
The Software is solely for internal, non-commercial use with your own applications and data. You may not redistribute outside your organization any files of the Software. You may not create derivative works of the Software. You may not decompile, disassemble or otherwise attempt to translate or seek to gain access to the source code of the Software. IBM reserves all rights not expressly granted to you.
No technical support will be provided by IBM as a result of this License.
3. Term and Termination
This License commences when you install the Software.
IBM may terminate this License, with or without cause, by providing notice to you. This License will immediately and automatically terminate without notice if you fail to comply with any material term or condition of this License. You may terminate this License at any time by deleting or destroying all copies of the Software and documentation. Unless either party terminates at an earlier date, your license for the Software expires with the next publicly available release of the Software, or on December 31, 1999 (whichever comes first). Upon any termination or expiration, you agree to immediately delete or destroy all copies of the Software. All terms and conditions, which by their nature should survive the termination or expiration of this License, shall survive. Information on future releases of the Software is available at:

4. Warranty Disclaimer and Limitation of Liability
IBM, its subsidiaries, suppliers, agents, employees and directors accept no liability for damages you may suffer as a result of your use of the Software, including any damages you claimed by you based upon any third-party claims. In no event will IBM, its subsidiaries, suppliers, agents, employees and directors be liable for any indirect, punitive, special, exemplary, incidental or consequential damages, even if IBM or any of its subsidiaries, suppliers, agents, employees or directors has been advised of the possibility of their occurrence.
YOU UNDERSTAND THAT THE SOFTWARE IS BEING PROVIDED TO YOU "AS IS", WITHOUT ANY WARRANTIES (EXPRESS OR IMPLIED) WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, QUALITY, PERFORMANCE OR FITNESS FOR ANY PARTICULAR PURPOSE.
Some jurisdictions do not allow the exclusion or limitation of warranties or consequential or incidental damages, so the above may not apply to you.
5. General
This License is entered into in the State of New York, United States of America, and is governed by and interpreted in accordance with the laws of the State of New York. Regardless of how or where you received the Software you agree that IBM has provided it to you in the United States.
You agree to comply with all applicable export laws and regulations.
This License is the only understanding and agreement that we have for your use of the Software. It supersedes all other communications, understandings or agreements (oral or written) we may have had prior to the commencement of this License. If any provision, in whole or in part, of this License is declared unenforceable at law, the rest of the provision and the License remains in effect. Only a written agreement signed by both of us can modify this License.
Notice to U.S. Government Users. If the U.S. Government is authorized to license the Software in accordance with this License, then this License applies. Otherwise, the Software is subject to U.S. Government Users Restricted Rights - Use, duplication or disclosure is restricted by the terms of the GSA ADP Schedule Contract with IBM Corporation.
Some components provided with the Software are not governed by this License and are instead subject to separate license terms and conditions. The terms and conditions governing those components are provided when installing or starting them or are found in the directories containing the components. By using, installing or starting a component, you agree to the applicable terms and conditions for that component.
